
Verdict of Public Environmental Court on Elimination of Dalma Gardens
According to “EcoLur” Informational NGO, the verdict of Public Environmental Court on the ongoing occupation of Dalma Gardens in Yerevan was sent to RA Prime Minister Nikol Pashinyan, RA Chief Prosecutor Arthur Davtyan and Yerevan Mayor Hayk Marutyan.
The Public Environmental Court as represented by its members – Nazeli Vardanyan (Environmental Lawyer), Inga Zarafyan (President of EcoLur Informational NGO), Hranush Kharatyan (publicist, ethnographer), Tehmine Yenokyan (journalist), ruled:
“1. To recognize the offenses committed in respect of Dalma Gardens as a crime against nature, humanity and state.
2. Apply to the Prosecutor General’s Office demanding:
a) Check the lawfulness of Dalma Gardens land mapping, cadastral records, status and category changes, land allocation, alienation, environmental impact assessment and expertise.
b) Check the proportion, equity, equivalence and sources of compensation provided to Dalma Garden land users.
3. Apply to RA Investigative Committee requesting:
a) Initiate criminal cases for unlawful mapping, status and category alteration of Dalma Gardens land areas, land allocation, alienation, environmental expertise, infringement of land use rights, destruction of historical and cultural values against environmental offenders and all offenders shall be liable recovering their damage caused to the state and citizens.
4. Apply to the Government of the Republic of Armenia requesting:
1. (a) Develop a plan on the restoration of Dalma Gardens environmental and historical-cultural complex, the establishment of a special protection regime, the preservation, restoration of land users’ rights, and compensation for damages.
(b) Compensation – Damages to land users who have not been compensated and/or received incomplete and adequate amounts of compensation.
c) Transfer 228.34 hectares of Dalma Gardens to the balance of “ArmForest” SNCO.
